We want to sell our father's car who has passed away last year. The RC is in his name. We have the death certificate, birth certificate (ours, proving we are legal heir) and an unregistered will.

We live in Uttarakhand and the car is a West Bengal registration. We will be taking the car to Kolkata ( via train). Our questions are:

1. Will it be possible for us to transport the car using train if it has the valid insurance, road tax paid etc and the death certificate of the person whose name is on the RC.

2. Can we sell it with the mentioned documents or will be need to change the RC in one of the children's name?

3. How long will this change of RC take?

The vehicle is a Diesel Indica Turbo. 2007 make. Ran only 35000 KMS and in good condition with a new battery.

In terms of RC
> Well you first need to check on RC Validity date as mentioned. Been in West Bengal registration used to be for 5 year and 15 year.
Is RC is still valid ? If yes then is next step

> You do not need to take car through Train, and no its not possible too and have unheard of in the past

> If considering to sell car, the car RC needs to be transferred to family member name. Below are documents
a) ID & Address proof of son/daughter/wife in whose name car to be transferred (Copy of PAN Card is mandatory document)
b) Car Original RC along with copy of Valid Insurance, PUC, Chassis Imprint
c) Death Certificate Copy from Local Registrar Office
d) Succession Certificate from Court
e) RTO Form 31 (Application for Transfer of Vehicle to Successor name)
f) RTO Form 29,30 (for effecting transfer)
g) tax Paid Copy (if available)

Basis same the vehicle will then be transferred to legal heir name,

Then the car can be sold by new owner.

However, to disclaim 13 year Old Indica Diesel although been less driven attract very less value in second hand car market. I doubt if there will be any buyers even beyond Rs 70,000 for the car in the best of condition. May even get offers of Rs 40000 or 50000 after whole exercise done of transfer. So - may ascertain that before initiating costs for transfer process
