I am thinking of buying a used car from an Auction, wondering what is the process to do RC transfer of this used car where buyer papers are not provided and car is sold on as on basis. Please advise

Below are the broad set of documents, which are required to transfer a car bought in an Auction

- RTO Forms :
> Form 20 (for Re-registration) - if vehicle is not registered along with RTO, else RC Copy in Original needs to be submitted
> Form 21 (Sale Certificate by the Auction Company with Sign and Stamp)
> Form 32, which states application for transfer of ownership for Vehicle bought in Auction.
> Court order - Session Court if the asset value is under 10 Lakh or DRT (Debt recovery tribunal involved) in case of more than 10 Lakh
> A Receiver is appointed by court along with PTS (Permission to sell) and Police Intimation is done. That PTS Copy needed
> Inventory copy duly signed and acknowledged when the car was lifted including vehicle condition duly mentioned
> Pre Intimation and Post Intimation copy with Court stamp
> Auction Sale Letter and NOC Copy from Auction Company to transfer
- Notarized Attested Copy of Insurance, PUC
- Notarized Copy of :- ID, Address Proof, PAN Card / Form 60
- Applicable Fees in form of Transfer charges / Road Tax etc
- Respective Authority Letter of the Auction Company (Issued by Respective State Govt & Bank / Insurance Company)

dear friends,

guide me pls.,

before 1 year i bought a car through auctions from the bank, that car was having hypothecation with some one.(he didnot pay due, so bank seized and sold through auction)

i bought the car without all document..except sales deed given by bank in my name..

i have only one proof that sales deed,,

now how can i proceed for getting new or duplicate RC book in my name,,

already 1 year finished...

refer reply#1 as posted for process w.r.t repossessed cars
As you mentioned that vehicle was hypothecated to bank,
Unsure, but If original RC is not available - then try to obtain FOP (Form of Particulars) from RTO based on vehicle registration number which state the name of original owner and submit in the documents as listed above.

Hopefully should help in for transfer !!

This post is helpful. Please tell me what are things to be checked before buying a repo car.

As also what are RTO remarks like STOP & WANTED.

Before buying, What all is to be checked with RTO and in the yard of the bank?

Which websites to follow to find a good deal.

How the transfer of ownership is carried out if the vehicle is purchased in public auction?

Any person who has acquired vehicle at a public auction conducted by or on behalf of the state or central Govt. shall by or on behalf of the state or central govt. shall apply with in thirty days of taking possession of the vehicle to the registering authority in whose jurisdiction applicant is residing accompanied by

Application on form 32.
Form 20.
Certificate of registration in original.
Sale certificate form 21 issued by the Auctioning Deptt. in favour of the owner of the vehicle.
OR The certificate or the order confirming the sale of the vehicle in his favour duly signed by the person authorised to conduct the auction.
The certified copy of the order of the Sate or Central Govt. authority auction of the vehicle.
Attested copy of the insurance in favour of purchaser.
Attested copy of pollution under control certificate.
Attested copy of address proof. GIR No./ Pan No. or Form 60/Form 61.
Road tax as applicable.
Registration/Re-registration fee.
Important : The Vehicle would be re-registation provided it complies the EURO -II norms.

sir we had purchased the JCB machine registered in the gurgaon from the auction of the bank , now we want the NOC from gurgaon rto office , as our office is in mumbai and wan tto transfer the same vehicle in mumbai , but while auction we didnt got the original RC book from the bank which was in the name of first party , so can you guide us how we can proceed with the formalities and what are the procedure

Depends - whether the vehicle is registered and RC available
If RC available - then only transfer fees and new smart card fees - which is very low in around rs 1000 - the work can be done

However - if the vehicle is un-registered or registered in some other state then appropriate road tax needs to be paid which varies based on the classification of the vehicle been bought
