Hi
I had sold off my vehicle to another person. But even after 1.5 years , the new owner has not transferred the ownership to his name.
What is the best course of action?

Its observed that some of the second hand car buyers do not transfer in RC as

> They seek to hold car for short term and sell car to another person, been the car value will depreciate in even higher once the Owner serial number will change from 2 to 3, Thus they keep the car with themselves without transferring and sell car based on signed RC Transfer forms by seller

> Due to Carelessness or documents not in order or worst malafide intent

As Owner
> He should ensure that vehicle RC should be transferred within 30 days of sale. Been otherwise in event of transfer not done - the car RC will show up in name of original owner in RTO records and any unfortunate road mis-hap or traffic offence will come in name of owner as per RTO Records. Although you may have a proof of sale in form of payment instrument, buyer documents - but why to enter in a hassle, when car already sold

> In event of any misuse of car in Illegal activities - can end up with court case.

So - as an owner
> If required hire a mediator broker and let papers be checked and handed over to him at time of sale so as to ensure RC Transfer in name of Buyer. Without complete Transfer Papers - never sell the car
> In case of mediator not hired - Its important to have under-taking signed with specified date from buyer by when he can transfer RC and follow up with registered post letter / emails and keep copy of same
> Also ensure to keep documents of sale with you and record in call conversations with date and time

Its of utmost importance to ensure RC been transferred to Buyer name

Now specific to your case as 1.5 Year been passed: Suggest to
> Meet Buyer and see if amicably he is ready to do transfer
> send 1 final correspondence email / registered post stating your previous follow ups

If in rare case - its not done - you can approach Police and lodge complaint of Possible Misuse of Car for Illegal activities as Buyer not transferring car in his name despite multiple follow ups
