My personal 5 seater car (Maruti Baleno,2016 make)is damaged in an accident,no other vehicle/object was involved.I am claiming total loss from the insurance company. I have to cancel my registeration of the car from RTO,Hisar(Haryana). The registeration was made in March 2016,so it is only7-8 months old.My question is, whether there is any provision in Vehicle registeration Act that i can get back any amount of Taxes Paid to the RTO in lieu of the cancellation

Hello,

Sorry to hear on accident !!

For refund of total loss vehicles - There is no clear outright process on same. However - technically

> if vehicle is deemed incapable of use and destroyed - in that case registration can be cancelled in RTO (though - official clause states that within 14 days the intimation has to be done to RTO)

> Basis same - an application for cancellation can be done and the pro rata refund can be issued by RTO. Been road tax payment is done for 15 years and vehicle usage is just mere a year - so technically - tax refund seems much a possibility

But - all which looks ease may not be
> In case vehicle has turned total loss and payable by Insurance company - it turns to be asset of Insurance company,

> Been RC would then be retained by Insurance company post claim settlement - i really doubt that RTO will proceed in road tax refund without RC in place.

> There is a clause of intimation to RTO within 14 days as mentioned in CMV - Central Motor Vehicle Act

I suggest to get in touch with Insurance company for retrieving RC and if done, may proceed ahead with RTO for refund of road tax
Hope should help

When the vehicle is total loss & insurance company has given certificate, RTO tax on pro-tata basis should be given back to the owner for the remaining period of registration.

Insurance company neither covers RTO tax nor does it consider at the time of Total loss / Net of Salvage base claim settlement.

There should be clear guidelines on the matter.
