What is the procedure to sell car to transfer in name of buyer and taking payment. Can you suggest a step by step guide while selling car without risk transfer including agreements and rto forms to be signed by both

Hello Diipak,

Hope you are referring to documents transfer !!
When you enter in a transaction with an independent dealer or seller,

- A simple sale agreement from Notary to be made of the transaction between buyer and seller with payment details (in form of cheque, draft to be mentioned), vehicle condition, status and handing over of RC, Insurance to seller with there photocopies
- The Sale agreement defines payment clause, owner status and responsibilty acknowledgement of car from date of handing over keys
- Once the payment is received, You have to sign in 2 copies of Form 29, Form 30 indicating intimation to RTO for your consent of transfer to name of buyer
- If the vehicle is hypo to any financial institution then Form 35 also need to be signed along with a NOC from Bank (as per payment clause structure in sale agreement)
- The original RC and Insurance along with RTO document, latest PUC copy and original keys to be handed over to seller

Its safe to keep a photocopy of :-
a) Copy of Sale agreement
b) Buyer ID and address proof
c) Cheque or DD Copy
d) Photocopy of RC, Insurance

p.s - there are many dealers and individuals who tend to avoid agreement, its best to be aware that till the RC is not transferred and in event of car keys handed over without any agreement - for any road accident / challan the onus comes on original owner.

hi,
I am moving abroad and plan to sell my car in India. I will have to leave early and hence my family will take care of selling the car. Please advise in this scenario when i am not present here, what is the process of selling the car.
I discussed with Bank and as per them to hand over NOC , they just need a letter from my end with copy of PAN.

What will be process for RTO.

Hello,

Will suggest to get
> RTO Form 29 and 30 - Signed as those will be considered for sale of car.

> RTO Form 35 - to be signed by registered owner and also to be authenticated by Bank for HP Removal

> Self Attested Copies required to be submitted of :- ID Proof, Address Proof.

May Note: 2 copies are required to be submitted of each form (29,30) & 3 copies of Form 35 at time of sale - So may handover a set of signed rto forms & id/add proof copies accordingly to family members

> RTO Offices also may call upon seller - in case of a Signature Mismatch or a Difference observed in ID Proof having Photo
So - may sign correctly.

> You may also issue an authority letter to family member for effecting sale of car - in case deal transaction goes on to a dealer.

Hello,

As long as all documents (ID & Address Proof), Signed RTO Forms are submitted to buyer - its not required for seller to visit in RTO

Only in cases - where there is signature mis-match or the concerned RTO Official feels a doubt on authenticity of documents - in that case only, seller is asked to visit in RTO Office in person

Hello,

I had bought new Maruti Suzuki Dzire Tour model for Ola/Uber purpose, bought in month September 2016. I have take a loan from mahindra finance for a tenure of 4years. Is it possible to sell my vehicle now? What happens to the loan amount?
