Vehicle RC Transfer Importance as per Law
As per Motor Vehicle Act and Supreme Court Verdict - Car Ownership is considered basis Owner name in Vehicle Registration Certificate i.e RC
Do note that
- If you sell Car without ensuring Ownership Transfer in RC, then do note that the Owner name as reflected in RC will also be held legally responsible in case of any Road Accidents (despite of having him sold the Used Car). This is as per Supreme Court Verdicts
- If you buy Car without ensuring Ownership Transfer or without Signed RTO Forms - Seller can lodge a case of Cheating, Suspicion of some illegal activities in Police basis ground that Buyer intentionally not transferring Car sand may use same in planned intention
Thus, before Buying or Selling Used Car, its imperative to know how ownership transfer happens with documents, transfer charges with Process note from both buyer and seller perspective.
Online RC Transfer Process
Now, you can easily apply for Transfer of RC Online
Step 1- Registration on Parivahan Site & Authenticate by Punching Car Number
Visit Parivahan site. Check Online Services - Vehicle related services and Register. If you do not have made an Account with Parivahan, then you need to Register first before Initiating RC Transfer Process.
Once Account Created and Logged in Check Online Services - Vehicle Related Service.
Punch in your Car Number, Last 5 Digits of Car Chassis number as can be checked from RC and Authenticate Mobile Number as used by using OTP.
Step 2- Online Transfer Form Filling
The Seller has to Select Service essentially in case of RC Transfer as 'Transfer of Ownership' in case of RC Transfer. Very Important: Do note that if Vehicle has Hypothecation (HP) then Hypothecation Termination also needs to be checked only if in possession of RTO form 35 and Bank NOC. If you are not in Possession of RTO Form 35 and Bank NOC then Transfer process will not be completed.
Fill Online Form for RC Transfer with Details of Seller, Buyer Filled in it including Name, Address. Once Details of Buyer, Seller Submitted. Then will also get a Page for taking Appointment as Scheduled basis available dates
Step 3 - Documents Upload & Payment
Upload Scanned copies of Address Proof, Form 29, Form 30, Insurance and RC Copy and make Online Payment needs to be submitted which is around Rs 530
Step 4- Submission of Documents in RTO
Visit RTO on Specified Date and submit in
- Printout as Generated of Payment Receipt, RTO Form 29,30
- Vehicle Documents as Original RC, Copy of Valid Insurance, PUC
- Buyer PAN Car along with Aadhaar Card for ID & Address Proof and 2 Passport Size Photo
- Seller ID & Address Proof
- One Blank Envelope with Buyer Address, Stamps equivalent to registered Post on to it. As RC is sent through Registered Post
Step 5 - Get Transferred RC
Transferred RC / Smart Card is sent by RTO within 7 days of Verification on address of Buyer. If there is any signature mis-match then buyer will also be asked to visit RTO with Original ID Proof for Verification Purpose.
Car RC Transfer Process - Updated in 2021 (Applicable, If Online Process not Available in your City)
Below is Common RC Transfer Process including Documents required for ensuring RC Transfer
- Original RC: Original RC Smart Card needs to be submitted in RTO
- Sale Transfer Forms: RTO Form Number 29, 30 are considered Sale Transfer Forms. This needs to be signed by both Seller and Buyer with 2 Copies
- ID and Address Proof of Buyer and Seller: Self Attested ID & Address Proof of both Buyer and Seller (Seller Address Proof on RC should match as with Present Address else an affidavit is required)
- Buyer PAN: Self Attested PAN Card of Buyer (if Purchase Transaction is less than Rs 50000) or Form 60,61
- Other Documents: Copy of Insurance, PUC Certificate, Vehicle Chassis Number Imprint
- Loan Hypothecation Removal (Only Required if Car RC/Insurance has HPA): If there is any Loan Hypothecation on RC or Insurance, then Valid Bank NOC along with RTO Form Number 35 duly signed by Bank and Owner needs to be submitted. Note: Generally NOC is Valid for 60 days from date of issuance.
- NOC Clearance Certificate (Only Required if Car Sold in Different City or District but within Same State): If say Ghaziabad Registerd Car needs to be registered in Bareilly (within Uttar Pradesh but different district) or say Mumbai Registered Car needs to be registered in Pune (within Maharashtra bit different district) then NOC needs to be additionally obtained. This is like a Clearance certificate from RTO that there is no Objection for Transfer to other RTO as no Court Case or no Traffic Offence pending on the car.

FAQs on Vehicle RC Transfer
» Generally the Seller is not required to be present in Person in RTO Office for transfer of vehicle. However, where the Signatures mismatch or case seems doubtful to RTO Officer - in those cases only the Seller is also called to be present in RTO Office with ID Proof along with Buyer for Verification Purpose, to avoid any fraudulent / stolen / ID theft Transfer.
» Before Handing over Car, important to check Buyer ID and Address Proof. Not all address proof are accepted by RTO. Like Rent Agreement, Driving License, Credit Card Statements, Appointment Letter or Postpaid Telephone bill are not accepted in RTO
» In Terms of Time Taken for Used Car RC Transfer - If Transfer Forms and Documents are submitted and in order - it does not take more than 2 weeks to get Transferred RC from RTO
» As matter of caution, the seller can submit Form TCR within 2 Weeks which is a transfer intimation to RTO Office after sale of vehicle along with Copy of ID & Address Proof of Buyer
» Although a Sale-Purchase Agreement do not hold much Value as Name Transfer in RC is what the most Important Criteria. But still to be on safer side, a 100 Rs agreement can well be done between buyer and Seller where Transfer Terms to be clearly specified along with Undertaking that from that day onwards of handing over Vehicle Key - entire Risk, Responsibility, Traffic offence remains as Buyer responsibility. Inter State RC Transfer - Updated in 2021
Sometimes Buyer belongs to one state and seller to other, in this case Transfer Process goes on like. Other than the Documents mentioned above in RC Transfer Process - in case of Inter State transfer, below documents are required :-
Home Location (RTO where Vehicle is Registered)
- Original RC along with Copy of Insurance, PUC needs to be submitted
- Id and Address Proof of Both Buyer and Seller
- NOC needs to be applied to other State where Vehicle needs to be Registered
- Signed RTO Form 27,28 (2 to 3 copies as mentioned)
- RTO Form 35 and Bank NOC (only applicable if vehicle Financed)
- Blank Envelope with Seller name and Address filled on it along with Rs 30 Stamps as NOC for Registered Post
Post Submission - RTO will issue you NOC along with Original RC which will be sent through Registered Post
Other State (where Vehicle needs to be Transferred)
- Original RC along with Copy of Insurance, PUC needs to be submitted
- Id and Address Proof of Buyer and Seller. PAN Card of Buyer if transaction more than Rs 50,000 will also be needed
- NOC Clearance Certificate as issued by RTO in Home Location
- Signed RTO Form 27,28,29,30
- RTO Form 20 for Re-Registration
- RTO Form 35 and Bank NOC (only applicable if vehicle Financed)
- NOC from NCRB (National Crime Record Bureau) that Vehicle is not Stolen, can be done Online - Click Here to Obtain
- Applicable Re-Registration Fees, Road Tax Charges based on Depreciated Value as per Ageing Value of Car carried as per respective RTO Officer. Demand Draft needs to be submitted for same equivalent to Road Tax Fees
- Blank Envelope with Seller name and Address filled on it along with Rs 30 Stamps as NOC for Registered Post
Important: In some States, Only BS-IV / Euro IV vehicles are getting registered in inter state due to latest emission norms (one need to check with local RTO office for same)

Transfer Fees in Used Car
Except Rajasthan where Road Tax is applicable on Buying Second Hand Car. There are no Road Tax or Re-Registration Charges to be paid in case of Transfer within same State. Only Required are :-
- Transfer Charges - which is like Endorsement for issuance of New RC in buyer name. Official transfer charges are Rs. 300 in most of the RTO Office
- New RC Smart Card Issuance - For issuance of New Smart Card, Charges are around Rs. 200 approx
- If Finance taken on Purchase of Used Car, then HP Addition Fees would be Rs. 1500
Process Note Valid in :- Above Process Note is almost Valid in all Cities, States or Union Territory of India. From Andhra Pradesh, Maharashtra, Haryana, Goa, Gujarat, Karnataka, Punjab, Tamil Nadu, Orissa, Rajasthan, New Delhi, Chandigarh, Kerala etc.
