Section 47 of Motor Vehicle Act

There have been instances in the past (even though few) including high end luxury cars like Porsche been impounded as resident of the state have taken registration mark of another state. This is due to the fact of Section 47 of Motor Vehicle Act, due to which vehicle owner had to apply for registration of his home state by again paying for RTO Charges.

Section 47 States : When a motor vehicle registered in one State has been kept in another State, for a period > 12 months, the owner of the vehicle need to apply in respective local RTO in State for the assignment of a new registration mark of that state

However its exception in some states, For example: Section 3 of Karnataka Motor Vehicle Act says that if you owe a vehicle in state for 6 months or more, the vehicle owner need to pay applicable Road Tax, and required to get the vehicle re-registered with Karnataka number. So - its advisable to check on, with local state laws - if you planning to move your car to a different state.

Documents for Car Registration

Basic and Most Important Document is Address Proof.  Some States ask for 1 copy of address and some even ask for 2 copies of Address Proof

However - Address Proof means a Valid Address Proof as per RTO Office definition - a residence proof document as issued by Centre / State or Utility Bills.

Some of them are :- Electricity Bill, Water Bill, Election Card, Aadhaar UID Card, 6 Month Old Nationalized Bank Account Statement having Address, Passport, Telephone Bill Copy of BSNL or MTNL. LIC Policy Copy etc

Along with it is required Valid ID Proof - which could be one of above having Photograph or Driving License, PAN Card copy etc.

If you planning to buy in Haryana, due to lower rto cost but eventually want to use the vehicle in AP, then avoid to (buy) register in Haryana - as you will again have to re-register in AP.
RC transfer and refund process is time taking

Nd I too have a query ..
I am a army officer now recently posted in bangalore..
I had purchased a indigo car from my dearest friend while I was posted in Maharashtra previously
but did not get the registration/transfer to my name...
Now I want to get the car registered in my name
1)is it enough if i just transfer the car to my name in Maharashtra or
2)should i change the registration to Bangalore and take a new number.
3)since I am central govt employee, my postings keep changing to all over the country ...so is it that I should change the registration and take a new number every time my posting changes to other state.also should I pay road tax.
3)is there any special ruling for central govt employee

Sir - For buying a used car - easiest is to get it transfer within the same city bearing the same registration mark

Inter-State Transfer cases are with hassle, and for effecting a new Registration mark of your new home city - re-registration charges to be paid.
It would be also be hassle to claim on refund of original road tax paid - due to location and city differences.
Also - there is no Online process for making an application for same

As per Motor Vehicle Act - Sec 47 - re-registration is mandatory if you going to use other state car for more than 12 months from date of bringing the car (The date generally is verified basis the last PUC Certificate as done in last state, Toll tax receipts etc)

For any exceptions for Government employee - Am sorry - to the best of my info - its not there !!

Hello Ashish, You need to get it re-register in Maharashtra
Yes - Octroi & Re-registration charges need to be paid as per applicable slabs of the city
For purpose of calculating price - depreciated value would be assessed by the RTO Officer
Yes - you may take invoice as originally issued - will help in RTO Officer to calculate depreciation based on the invoice.

Hi Gagan, thanks for all the information provide. They are indeed very informative.

I have taken a Swift Dzire via car lease in Aug 2013 in Gurgaon. I now need to foreclose it as i am moving to a different organization in Hyderabad. The car as obvious is in the company's name and once i foreclose it i.e. get the NOC from existing company, i need to get it transferred to my name. I have following queries in this regard:
1) What are the ownership transfer charges in Haryana?
2) I believe i need to get it re-registered in Hyderabad even though the current registration was done less than a year ago. In such case what are the registration charges in Hyderabad? Exshowroom price was Rs. 6.4 lacs and i believe the depreciated value say in March/ April 2014 will be below 5.5 lacs
3) Can i ask back the road tax from Gurgaon RTO. If yes then how much that would be and how much time will it take?

It will be really helpful if you can reply ASAP. Thanks in advance!

Hi Gagan, found this site to be very informative. Thanks for all of it.
I took a Swift Dzire through company lease in August 2013 and now need to foreclose it as i am moving to a different organization in a different city. Currently I am in Gurgaona and moving to Hyderabad. The car as obvious is on registered on company's name and once i foreclose it i.e. get NOC from company and other documents, I would need to get it transferred to my name.

I have few queries as below:
1) What are the Ownership Transfer charges in Haryana?
2) I believe i would need to get it re-registered in Hyderabad. So what are the registration charges there? Ex-showroom price was around 6.40 lacs and registration was of August 2013. So i believe the depreciated value if calculated in March/April 2014 should come less than 5.5.
3) Can i ask back road tax from Gurgaon RTO? If yes then how much that will be?

Your reply will be really helpful. Thanks in advance!

Hello,

Glad to hear that. Pl find point wise reply :-

a) Official Transfer charges are very less - its under Rs. 1000 for Transfer and issuance of New RC. Unless you hire a middlemen who may charge you anything from Rs. 3000 - 5000.
Refer dox - http://www.mycarhelpline.com/index.php?option=com_latestnews&view=detail&n_id=622&Itemid=10

b) Depreciated value is calculated by rto officer basis there own slabs, which is in range of 5% - 10% for 1st year. SO the value could be anywhere around 5.8 - 6 Lakh.

c) Yes - you can demand for refund of road tax paid, once the car is re-registered in Hyderabad.
Refer one similar thread :- http://www.mycarhelpline.com/index.php?option=com_easydiscuss&view=post&id=1024&Itemid=78

Hello, Glad to hear that. Pl find point wise reply :- a) Official Transfer charges are very less - its under Rs. 1000 for Transfer and issuance of New RC. Unless you hire a middlemen who may charge you anything from Rs. 3000 - 5000. Refer dox - http://www.mycarhelpline.com/index.php?option=com_latestnews&view=detail&n_id=622&Itemid=10 b) Depreciated value is calculated by rto officer basis there own slabs, which is in range of 5% - 10% for 1st year. SO the value could be anywhere around 5.8 - 6 Lakh. c) Yes - you can demand for refund of road tax paid, once the car is re-registered in Hyderabad. Refer one similar thread :- http://www.mycarhelpline.com/index.php?option=com_easydiscuss&view=post&id=1024&Itemid=78 Trust it helps !!

Hi Gagan

How much % I have to pay for New car (6-10 Lakh) registration if the
Rates are revised in Panchkula(Haryana) in Jan-14.

Is BSNL landline bill and LIC Policy in name of my son(minor)sufficient for the registration as address proof.

Regards
Rajneesh Jindal

The revised rates yet to be officially announced with the effective date of implementation. It however is estimated at 20% - which is almost 3x than the present rates.
