Hello,
My car is 1985 manufactured Mercedes-Benz w123 240D and registered in Kolkata MV in 1996.
Now, as the tax is pending i went for payment of it up-to-date. The taxation dept. has told me after searching that the car original value is not traceable as the file in their records is missing due to shifting/ lost/ fire damage. They have adviced me to produce the original or duplicate invoice from the MB company or get a declaration of the ex-showroom price of the car so that the tax can be calculated accordingly based on the variant and current Govt. rates and slab.
When i personally visited the MB dealer and also wrote mails. I was replied that they do not have any records of such car as it was imported directly by the owner and not bought through them and also they never sold this model in india as it was discontinued in 1986 and their company did not have any dealerships in india pre-90's.
However this also failed and i am not able produce any supporting documents to prove the price of the car.
In this critical hardships faced, please advice me how to proceed and get my tax paid up-to-date.

Hello,

You need to connect with RTO Officer Incharge for way forward by proposing
> road tax to be paid based on the value as assessed when 5 year tax was paid in 2011/ 2012
The officer might have to do backward calculation based on tax receipt to compute in estimated value as taken as base in that year.

In case that does not work - Also - may connect with Mercedes Benz India - to share pricing of some other model having
> Build in 1990s
> 2.4 Litre Engine

By that way you can furnish in info to RTO that some other model from same Manufacturer having same Engine capacity was having the price in stated amount. Possibly road tax can be paid based on same due to Engine capacity and Manufacturer remains same

Im grateful for your reply.
But the saddest part is Motor vehicles is saying it is not possible for them to back calculate the tax as there has been many tax slabs and rate changes till date so it is not possible for them .
Regarding the Company, the MB has been kind to reply to my mails mentioning that it is not possible for them to ascertain the price as they were not operational in india pre-90's and is not feasible for them.
Now, at this juncture my only option left is to file RTI application asking the RTO itself to show me the legal procedure, how to ascertain the price of the car when invoice is not available.
If this also fails then file a Writ petition against MV dept. and get directions for the court for payment of my tax.
